Terms of Use

Applies to: the Feeziq mobile app for iOS and Android (bundle ID com.chatrsimab.feeziq), the Feeziq Wear OS / watch companion, and the website at feeziq.com. In these terms we call all of it “Feeziq” or “the app”.

1. The agreement

These Terms of Use are a binding agreement between you and Farzad Chatrsimab, who operates Feeziq (“we”, “us”, “our”).

By creating an account, or by using Feeziq in any way, you accept these terms. If you do not accept them, do not use the app.

Our Privacy Policy explains what we do with your data and forms part of this agreement. Read it alongside these terms.

2. Who may use Feeziq

You may use Feeziq only if:

• You are at least 16 years old if you are in the European Economic Area or the United Kingdom, or at least 13 years old elsewhere. Where your country sets a higher age of digital consent, that age applies to you.
• You can form a binding contract with us, and you are not barred from doing so under any applicable law.
• You have not previously been removed from Feeziq for breaking these terms.

Feeziq requires an account. There is no anonymous or guest access.

3. Your account

• Give accurate information when you register, and keep it current. Your height, weight, age and goals drive everything the app calculates, so inaccurate entries produce inaccurate plans.
• One account per person. Do not share your account or your credentials.
• You are responsible for everything that happens under your account. Tell us immediately, through feeziq.com, if you believe someone else has access to it.
• Usernames are first-come, first-served. We may reclaim a username that is impersonating someone, infringing a trademark, offensive, or on our reserved list.
• We do not store your password in readable form and cannot recover it for you. Use the password reset flow, or your Google or Apple sign-in.

4. Health and safety. Read this section.

• Consult a qualified clinician before starting any exercise or diet programme, and especially if you are pregnant or postpartum, have a heart condition, high blood pressure, diabetes, an eating disorder or a history of one, an injury, or any chronic condition, or if you take medication of any kind.
• Stop exercising immediately and seek medical help if you feel chest pain, dizziness, faintness, breathlessness beyond normal exertion, or pain that is sharp rather than muscular.
• Calorie, macronutrient, hydration and MET values in Feeziq are estimates. Estimates produced by AI from a photo or a written description are approximations and are often wrong in detail. Do not rely on them for any clinical purpose, and do not use them to manage a medical condition.
• You decide what you do with your body. You accept the risks inherent in physical exercise and in changing your diet, and you exercise and eat at your own risk.
• Feeziq is not appropriate for the treatment of eating disorders. Its calorie tracking, streaks and weight logging can be harmful in that context. If you are struggling, please stop using the app and speak to a professional.

5. What Feeziq offers

Feeziq offers workouts and workout plans, diet plans and meal logging, weight and hydration tracking, barcode and photo-based food recognition, AI-generated plans, an AI coach, achievements, streaks, leaderboards, direct messaging, and a social profile.

Free accounts. Most of the app is free. Free accounts see banner ads, and some actions, including logging a completed workout and submitting a meal intake, require watching a rewarded ad first.

PRO accounts. A paid subscription removes ads and unlocks additional features, which currently include broadcasting to plan members, viewing plan member lists and certain planning and analysis tools. The exact set of PRO features changes as the app develops.

We may add, change, suspend or remove features at any time. If we withdraw a paid feature in a way that materially reduces what you have paid for, section 6 explains your options.

6. Subscriptions, billing and cancellation

Subscriptions are sold and processed through the Apple App Store or Google Play, not by us directly. We use RevenueCat to manage entitlements.

• Price, billing period and any free trial are shown to you in the app before you confirm. Prices vary by country and may change; changes never apply to a period you have already paid for.
• Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store charges the account you bought with.
• Free trials, where offered, convert into a paid subscription unless you cancel before the trial ends. If you have already used a trial for a product, you are not entitled to another.
• Cancel any time in your Apple App Store or Google Play account settings. Cancelling stops the next renewal. It does not end the current period, and PRO access continues until that period expires.
• Deleting the app does not cancel a subscription. Deleting your Feeziq account does not cancel it either. Cancel through your store.
• Refunds are handled by Apple and Google under their own policies, and we generally cannot issue them. Where the law of your country gives you a statutory right of withdrawal or a refund right, that right stands regardless of anything in this section.
• Unused portions of a period are not refundable except where the law requires it.

7. Advertising

Free accounts see ads served by Google AdMob, including banners during workout rest periods and rewarded ads before certain actions. We do not give advertisers your health data. Ads are supplied by third parties and we do not endorse what they promote. Do not attempt to spoof, automate or otherwise falsify ad views to obtain rewards.

8. Your content

“Your content” means everything you put into Feeziq: profile details and photos, biography, workout and diet plans you build, banners you upload, messages you send, meal and activity descriptions, ratings and reports.

You keep ownership of your content.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display purposes, and transmit your content, solely in order to operate, secure and improve Feeziq and to deliver it to the people you have chosen to share it with. This licence exists only so the app can function. It ends when you delete the content or your account, except for copies retained in backups for the period described in the Privacy Policy, copies the recipient of a message still holds, and anything we must keep by law.

You confirm that you have the rights to everything you upload, and that it does not infringe anyone else’s rights.

We do not routinely review content, but we may remove anything that breaks section 9, and we may retain records of removed content for safety and legal purposes.

9. Acceptable use

Do not:

• Post or send anything unlawful, harassing, hateful, threatening, defamatory, sexually explicit, or that exploits or endangers a minor
• Impersonate any person, or misrepresent your affiliation with anyone
• Promote self-harm, disordered eating, or unsafe weight loss, or use the app to coach anyone else toward those things
• Give medical, nutritional or training advice to other users in a way that presents you as a licensed professional when you are not
• Send spam, chain messages, or unsolicited promotion, including through the broadcast feature
• Scrape, crawl, or bulk-download data from Feeziq, or use bots or automation against it
• Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it
• Interfere with our infrastructure, bypass App Check or any other security or rate-limiting measure, or access accounts or data that are not yours
• Falsify workouts, meals, streaks, XP or leaderboard standing, or manipulate referrals
• Resell, sublicense or commercially exploit Feeziq or its content
• Use Feeziq to build a competing product, or to train a machine learning model on its content

Report anything that breaks these rules using the in-app report and block tools.

10. Messaging and other users

Feeziq lets you message other users and follow them. You are responsible for what you send. You can block any user at any time, which stops messages in both directions.

Message content is encrypted at rest, not end to end. As explained in the Privacy Policy, we retain the technical ability to read messages and will do so where the law requires it or where we are investigating reported abuse.

Other users are not vetted by us. We are not responsible for what they say, for the accuracy of their advice, or for anything that happens between you and them, online or offline.

11. XP, streaks, achievements, leaderboards and referrals

XP, streaks, achievements, prizes and leaderboard positions are features of the app, not property. They have no monetary value, cannot be bought, sold, transferred or exchanged for anything of value, and can be adjusted, reset or removed at our discretion, including when we detect manipulation or when we change how a metric is calculated.

A referral can be redeemed once per account, cannot be changed afterwards, and awards XP only. Referral rewards are not cash, credit or a discount, and we may withdraw the referral programme at any time.

12. AI features

Feeziq uses Google’s Vertex AI to recognise food from photos and text, to interpret described activities, to generate workout and diet plans, and to power the AI coach. Section 5 of the Privacy Policy explains what is sent.

• AI output is generated automatically and is not reviewed by a human before you see it. It can be wrong, incomplete or unsuitable for you.
• Treat AI output as a starting point, never as instruction. Section 4 applies in full to anything the AI produces.
• Do not enter medical details, diagnoses or medication information into free-text AI fields.
• Do not use the AI features to attempt to generate content that breaks section 9, and do not try to circumvent their safety instructions.

13. Third-party services and data

Feeziq depends on services we do not control, including Google Firebase and Vertex AI, Google AdMob, RevenueCat, the Apple App Store, Google Play, Open Food Facts, and an IP geolocation lookup. Their availability, accuracy and terms are their own.

Nutrition data for scanned barcodes comes from Open Food Facts, an open community database. Its entries are contributed by the public, may be incomplete or wrong, and are licensed under the terms Open Food Facts publishes. We do not verify them.

14. Our rights in Feeziq

Feeziq, including its software, design, text, graphics, animations, exercise and food catalogues, and the Feeziq name and logo, belongs to us or our licensors and is protected by intellectual property law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the app on devices you own or control, for your own non-commercial use, in accordance with these terms and with the rules of the store you downloaded it from. That is the whole of what you get. All other rights are reserved.

15. Feedback

If you send us ideas, suggestions or bug reports, we may use them freely and without owing you compensation, credit or confidentiality. Do not send us anything you consider confidential or proprietary.

16. Suspension and termination

You may stop using Feeziq at any time, and may delete your account at feeziq.com.

We may suspend or terminate your account, or restrict features, if you break these terms, if we are required to by law, or if your use puts other users, our infrastructure or our providers at risk. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond. For serious breaches, including anything involving the safety of a minor, threats, or attacks on our systems, we may act immediately and without notice.

If we terminate your account without cause and you hold an unexpired paid subscription, you may seek a pro-rata refund through the store you purchased from.

Sections 8 (as to licences already granted), 11, 14, 15, and 18 through 25 survive termination.

17. Deleting your account

You can delete your account at feeziq.com. Deletion removes your data as described in the Privacy Policy. It is permanent: your workouts, plans, history, streaks, XP and messages cannot be restored afterwards. Cancel any subscription separately, through your store, before deleting.

18. Changes to these terms

We may update these terms as Feeziq changes. The “Last updated” date above always reflects the current version. For material changes we will give you notice in the app or by email before they take effect. Continuing to use Feeziq after that means you accept the new terms. If you do not accept them, stop using the app and delete your account.

19. Disclaimers

To the fullest extent permitted by law, Feeziq is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the app will be uninterrupted, secure or error-free, that its calculations, catalogues or AI output will be accurate, that defects will be corrected, or that it will meet your goals. Fitness results depend on factors we do not control.

Nothing here excludes any warranty or right that cannot lawfully be excluded. In some countries consumers have guarantees that apply regardless of what these terms say, and those guarantees stand.

20. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of Feeziq.
• Our total liability for all claims relating to Feeziq in any 12-month period is limited to the greater of the amount you paid us for the app in that period, or fifty euros.

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If your country does not allow some of these exclusions, they do not apply to you, and our liability is limited to the minimum the law allows.

21. Indemnity

To the extent permitted by law, you agree to indemnify us against claims brought by a third party arising from your content, your use of Feeziq, or your breach of these terms. This does not apply to consumers where local law prohibits it.

22. Governing law and disputes

These terms are governed by the laws of the country in which Feeziq’s operator is established, without regard to conflict of law rules, and the courts of that country have jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, and you may also bring proceedings in your local courts. Consumers in the European Union can use the European Commission’s online dispute resolution platform.

Before starting formal proceedings, please contact us through feeziq.com so we can try to resolve the matter directly.

23. Apple App Store

This section applies if you obtained Feeziq from the Apple App Store, and Apple’s terms require it.

• This agreement is between you and us only, not with Apple. Apple is not responsible for Feeziq or its content.
• Your licence to use Feeziq is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support for Feeziq.
• If Feeziq fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Feeziq.
• Apple is not responsible for addressing any claim by you or a third party relating to Feeziq, including product liability claims, claims that Feeziq fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• If a third party claims that Feeziq infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

24. Google Play

If you obtained Feeziq from Google Play, your use is also subject to the Google Play Terms of Service. This agreement is between you and us, not with Google, and Google is not responsible for Feeziq.

25. General

• If any provision of these terms is held unenforceable, the rest remains in force and the unenforceable part is limited to the minimum extent necessary.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign or transfer these terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets, on notice to you.
• These terms, together with the Privacy Policy, are the entire agreement between you and us about Feeziq, and replace any earlier version.
• We are not liable for failure to perform caused by events beyond our reasonable control.
• These terms are written in English. A translation is provided for convenience only, and the English version governs.
